If the user is a minor, the user must state and acknowledge having received authorization from his parents or legal guardian(s) in order to subscribe to and use Joomeo. The legal guardian(s) have accepted to guarantee respect by the user of all of the provisions in the present Terms of Use.

Joomeo membership ("Membership") is available to you if you submit certain requested information to Joomeo, including your name and correct email address. When you become a Member, you must provide Joomeo with true, accurate, current, and complete information about yourself when such information is requested by the Service (whether by questionnaires, surveys, registration forms, or other informational requests).

All content in the site is a collective work owned by Airsens SAS / Sight Design LLC and is protected by international copyright laws. Copyright 2007-2008 Airsens SAS / Sight Design LLC. All rights reserved. All elements comprising the site, including without limitation, the text, site design, logos, graphics, icons and images, but excluding User Content (as defined below), as well as the selection, assembly and arrangement thereof (which selection, assembly and arrangement thereof includes User Content) are the sole property of Airsens SAS / Sight Design LLC or its licensors, and are protected by U.S. and international copyright laws. All software used in the site is the property of Airsens SAS / Sight Design LLC or its licensors, and such software is also protected by U.S. and international copyright laws. Permission is granted to electronically display and electronically copy and print hard copy portions of the site for your own personal, non-commercial use. Any other use, including the reproduction, modification, distribution, transmission, republication, display or performance of any content of the site is strictly prohibited.

The trademarks, service marks, trade names, trade dress, logos, designs, and sounds associated with the site are owned by Airsens SAS / Sight Design LLC or third parties who have authorized their use. Without limiting the foregoing, Joomeo and Airsens are trademarks of Airsens SAS / Sight Design LLC.

You agree not to use the site or any products or services available on the site for any purpose that is unlawful or prohibited by these terms and conditions. You agree not to post or submit to the site any User Content or other material that (a) infringes the copyright, trademark, trade secret or other proprietary rights of others; (b) violates the privacy or publicity rights or other personal rights of others; (c) is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another party; (d) impersonates another person; or (e) in general which not respect the French Law.

You further agree not to submit any User Content or other materials that contain viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information. You may not attempt to gain unauthorized access to the site or any products or services available on the site, other accounts, computer systems or networks connected to the site through hacking, password mining, the impersonation of others, the unauthorized use of another’s user name, password or other information, or any other means. You agree not to use any robot, spider, other automatic device, or manual process to monitor or copy pages of the site or the content contained herein without Airsens SAS / Sight Design LLC’s express prior written permission. You agree that all identifying information submitted to the site (including without limitation your name and email address) will be complete, accurate and truthful.

Airsens SAS / Sight Design LLC has the right, but not the obligation, to monitor, edit or remove any content from the site that, in its sole discretion, is unacceptable, undesirable, inappropriate or in violation of these terms and conditions.

We are liable in accordance with these terms and conditions only. Any claims not expressly agreed on in these terms and conditions, including claims for compensation – for what legal reason ever - are excluded. In any case they are limited to a case of gross negligent breach of contract on our part at least. In addition, claims for compensation are in all cases limited to the value of material only.

For reasons of security and in order to avoid losses of valuable samples and data carriers, we request that these be sent to us by registered letter only. The completed order will then be returned by us in the same manner. Samples will be treated with the greatest of care; liability for damage or loss is expressly excluded.

If so required, we recommend taking out transport insurance. This also applies to the handling and the shipping of valuable data carriers and samples for production purposes.

These Terms constitute the entire agreement between you and Joomeo governing your use of the Service. In the case of inconsistencies between these Terms and any information included in off-line materials (for example, promotional materials and mailers), these Terms will always control. You may also be subject to additional terms and conditions that may apply when you use Joomeo Affiliate services, third-party Content, or third-party software.

The failure of Joomeo to exercise or enforce any Term will not constitute a waiver of such Term. If any Term is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.

Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the Service or these Terms will be filed within one year after such claim or cause of action arose, or be forever barred.
